1. Scope and operator

These terms govern the use of amusementrides.com (the "Platform"), operated by:

The Platform is a business-to-business catalogue: it presents amusement rides from participating manufacturers to parks, operators, developers and other professional users. It is aimed exclusively at businesses (entrepreneurs within the meaning of Section 14 German Civil Code) and not at consumers.

2. Use and registration

Browsing the category pages is possible without registration. Full ride details and direct contact with manufacturers require a free account. Some functions – such as additional filters, operator satisfaction and 3D models – are reserved for premium members. Accounts are personal; access data must not be passed on. You are responsible for keeping your password confidential and must inform us without delay if it may have been compromised.

When registering you state whether you are a park operator or owner, a park developer, or another type of professional user. Please keep your details accurate and up to date.

3. Manufacturer accounts

Manufacturers can register themselves. A manufacturer profile and its rides only become publicly visible after we have approved the account. We may refuse or withdraw approval, in particular where details are incorrect, incomplete or misleading, without stating reasons.

Manufacturers receive inquiries about their own rides, including the name, company, email address and message of the person asking – by email and in their account area. A manufacturer must use these details only to answer that inquiry and the business relationship arising from it. Using them for general advertising, newsletters, address trading or passing them on to third parties is not permitted without the separate consent of the person concerned. The manufacturer is an independent controller for this data and is responsible for complying with data protection law, including answering requests for access or erasure. Breaches entitle us to block the account under Section 11.

4. Content provided by manufacturers

Manufacturers are solely responsible for the content they upload – technical specifications, descriptions, references, photos, logos and 3D documents.

By uploading, the manufacturer warrants that the content is accurate to the best of its knowledge and that it holds all necessary rights, in particular copyright and rights of use for images, drawings and documents, and that no third-party rights are infringed. The manufacturer grants us the non-exclusive right to display this content on the Platform and to use it for the Platform's own promotion. Manufacturers indemnify us against third-party claims arising from content they provided.

5. 3D models uploaded by manufacturers

Manufacturers can upload 3D models of their rides as GLB files at scale 1:1. When a model is uploaded, we check automatically that it is a GLB file and read its dimensions. Beyond that we do not check it – neither for technical correctness nor for completeness.

The models are shown to premium members in a 3D viewer on the ride page. They are not offered for download. They remain the content of the manufacturer: premium members may look at them on the Platform, but may not copy, extract or pass them on without the manufacturer's consent.

A model is an illustration, not planning data. Satisfy yourself that it is correct – by asking the manufacturer – before using it for planning or manufacturing.

We accept no liability for models provided by third parties: not for their content, not for their accuracy, not for their completeness and not for their fitness for a particular purpose. Statutory liability under Section 12 of these terms remains unaffected.

Please report a model you consider unlawful to sascha.budde@buddes.de. We will remove it without delay and, where necessary, block the account concerned.

6. Editorial entries

Not every manufacturer shown on the Platform is registered with us. For some companies we have compiled basic ride data ourselves from publicly available sources. Such entries are marked as editorial entries on the ride card and carry a note on the ride page stating that the data was not supplied or checked by the manufacturer. We use no photos, logos or drawings of these companies. A manufacturer whose data we have recorded can ask us at any time to correct or remove the entry; please write to sascha.budde@buddes.de.

7. All data without warranty

All information on the Platform is given without warranty ("ohne Gewähr"). This applies to data supplied by manufacturers, to our own industry estimates and to editorial entries alike. Technical specifications, dimensions, capacities, speeds, guest height limits, budget classifications and satisfaction figures are non-binding guidance to help you shortlist rides. They are neither an offer, nor a quotation, nor an assurance of any property or of suitability for a particular purpose.

Many entries describe a model family that is built in several sizes, so the figures vary from installation to installation. Figures may also be incomplete or out of date.

Before you rely on any figure – for a budget, a site layout, a building application, a procurement decision or a contract – confirm it in writing with the manufacturer concerned. Statutory liability under Section 12 of these terms remains unaffected.

8. Role of the Platform

We present rides and forward inquiries. We are not a party to any contract concluded between a user and a manufacturer, we act neither as agent nor as broker, and we owe no commission. Any purchase, delivery or service contract is concluded exclusively between the user and the manufacturer. We do not warrant the accuracy, completeness or currency of manufacturer data and give no assurance that a ride is suitable for a specific project.

9. Satisfaction ratings

Park operators and owners can rate rides that stand in their park on a scale from 0 to 10. Ratings must reflect the rater's own genuine experience with a ride actually operating in their park. Ratings of one's own products, ratings placed on behalf of a manufacturer, and any coordinated attempt to influence the average are not permitted. We may remove ratings that breach these rules and block the accounts involved. The ride pages show the average and the number of ratings only, never the individual park.

10. Availability

We operate the Platform with care but do not guarantee uninterrupted availability. Maintenance, technical faults and changes to the range of functions are possible at any time.

11. Blocking and deletion

We may block or delete accounts that breach these terms, contain incorrect information or are used abusively. You can delete your account at any time by contacting us; we will then delete your personal data unless we are legally required to retain it.

12. Liability

We are liable without limitation for damage caused intentionally or by gross negligence, and for injury to life, body or health. In cases of slight negligence we are liable only for breach of a material contractual obligation and only up to the foreseeable damage typical for this type of contract. We accept no liability for the content of manufacturer entries or for business decisions taken on the basis of information found on the Platform.

13. Term

The user relationship runs for an indefinite period and can be terminated by either side at any time without notice. Use of the Platform is currently free of charge; we will announce any future paid services before they take effect and they will require separate agreement.

14. Applicable law and jurisdiction

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Where the user is a business, the exclusive place of jurisdiction is our registered office in Germany.

15. Changes to these terms

We may amend these terms where necessary, for example when functions change or the legal situation develops. Registered users will be informed of material changes by email.
